About The Military Claims Act (MCA)

The Military Claims Act (MCA) allows certain military personnel and their families to recover compensation for medical malpractice and other injuries. The Military Claims Act helps in a manner similar to the Federal Tort Claims Act (FTCA), but allows qualified plaintiffs to adjudicate their claims only when the injuries or wrongful death occurred outside of the U.S.

The MCA may allow military victims of medical malpractice committed by employees of the U.S. government to secure compensation when their claim falls outside the scope of the FTCA. The Military Claims Act is important because it was designed to protect members of the armed forces and their families who would otherwise have no legal rights to recourse. Although most military medical malpractice claims fall under the FTCA, the MCA serves an equally important role in supporting military personnel injured outside the U.S.

If you believe you or a family member may have a negligence claim under the Military Claims Act or the FTCA, contact us to discuss your situation with an experienced MCA lawyer. At McKeen & Associates, P.C., we understand the complexities involved with injury claims in a military setting.

McKeen & Associates is a Michigan-based law firm with a national presence in litigating personal injury and medical malpractice lawsuits.

Do I Need A Military Malpractice Claims Attorney?

When medical negligence occurs in a U.S. military setting, the patient generally must file a malpractice claim to recover compensation. The injured serviceperson should not feel guilty about coming forward with a claim, as he or she is simply using the recourse our government put in place for victims of military medical malpractice.

Bringing a claim under the Military Claims Act or Federal Tort Claims Act necessitates compliance with strict administrative procedures to avoid forfeiting one’s right to recourse. The medical malpractice lawyers at McKeen & Associates understand how to navigate through the MCA and FTCA. Even more important, we are experienced and highly regarded medical malpractice attorneys who understand what’s necessary to obtain full compensation for our clients.
